LAWS5113: Banking and Financial Instruments

2024 unit information

This unit aims to provide students with: * An overview of the legal regulation and supervision of banks and other Authorised Deposit-taking Institutions (ADIs); * An understanding of the legal basis of the relationship between banks, ADIs and their customers, and an overview of the more common rights and duties that adhere to the banker/customer relationship; * An introduction to negotiable instruments (cheques and bills of exchange), letters of credit and performance bonds, and guarantees; * An introduction to the Personal Property Securities Act 2009 and its impact on secured lending, including taking security over ADI accounts, and accounts payable.

At the completion of this unit, you should be able to:

  • LO1. Analyse and evaluate the substantive content and operation of banking and financial instruments law in Australia, focusing on selected topics.
  • LO2. Identify and explain key legislative sources, common law, and equitable doctrines that impact the regulation of banking and financial instruments law in Australia.
  • LO3. Critically analyse and resolve legal problems arising in the context of Australian banking and finance law, employing appropriate legal principles and theories.
  • LO4. Apply legislative and common law principles to construct solutions to complex legal scenarios and problems encountered in bank lending.
  • LO5. Develop sound, logically-structured legal arguments in response to complex legal problems and communicate these to diverse audiences.
