2024 unit information

The content of this unit of study will be the following topics: Economic Theory of Competition Law; the Concepts of competition, market definition, market power, substantial lessening of competition and public benefit; Part IV: Cartels - Civil and Criminal Prohibitions; Section 45 Contracts, Arrangements and Understandings; Section 46 Misuse of Market Power; Section 47 Exclusive Dealing; Section 48 Resale Price Maintenance; Section 50 Mergers; Part IIIA Access to Services; Part VI Remedies and Enforcement; Part VII Authorisations and Notifications. The intended outcomes for students who successfully complete this unit are that they will have a firm grasp of the operation of the competition law provisions of the Competition and Consumer Act 2010. At the completion of this unit, you should be able to:

  • LO1. demonstrate an understanding of the different views on the question of whether and how competition law should regulate economic activity by considering the economic arguments for competition law, and considering how they are reflected in the CCA and other relevant legislation, and how they are implemented by the ACCC, the Courts and the Tribunal.
  • LO2. demonstrate a comprehensive understanding of the fundamental concepts of competition law including markets, competition, market power, substantial lessening of competition and public benefit such as to enable you to apply those parts of the CCA which are studied in the course.
  • LO3. demonstrate a comprehensive understanding of Part IV of the CCA and other relevant provisions (eg. access and remedies) and proficiently apply that knowledge to fact situations.
  • LO4. apply the knowledge acquired in the unit to their practice in this area of law, undertake more specialised study in this field and engage in research in this field.
  • LO5. demonstrate advanced research and writing skills.
  • LO6. acquire and demonstrate ability to synthesise a range of legislative and judicial rules and principles.
  • LO7. demonstrate capacity to formulate and defend a coherent and persuasive argument.
