LAWS6061: International Environmental Law

Intensive April, 2020 [Block mode] - Camperdown/Darlington, Sydney

This unit aims to provide an introduction to the framework, concepts, sources and techniques of international environmental law, and to provide an overview of international law responses to current and emerging environmental challenges. The history and framework of international environmental law will be examined before exploring a range of topical international environmental law issues, including atmospheric protection and climate change, hazardous substances and wastes, biodiversity and GMOs, the protection of marine living resources, the protection of freshwater resources and issues concerning trade. The unit will also survey the influence of international environmental law on domestic environmental law through case studies. Overarching themes will include the interdependence of environmental issues, the effects of scientific uncertainty on international environmental regulation, implementation of international environmental obligations between states at difference levels of economic development and the need for effectiveness in implementation and enforcement.

Assessment summary

For students who attend the first block of two seminar days in person and participate in the negotiation exercise.

Participation in the exercise is weighted 30% and the take-home assignment (4,000 words) is weighted 70%.

The take-home assignment will be written between 20 April and 4 May.

For students who will participate in the unit through lecture recordings only.

There will be an essay (4,000 words) weighted 50%; and the take-home assignment (4,000 words) will be weighted 50%.

The take-home assignment will be written between 20 April and 4 May.

Assessment criteria

The University awards common result grades, set out in the Coursework Policy 2014 (Schedule 1).

As a general guide, a high distinction indicates work of an exceptional standard, a distinction a very high standard, a credit a good standard, and a pass an acceptable standard.

Late submission

In accordance with University policy, these penalties apply when written work is submitted after 11:59pm on the due date:

  • Deduction of 5% of the maximum mark for each calendar day after the due date.
  • After ten calendar days late, a mark of zero will be awarded.

The late submission of a piece of assessment, which has not been granted an extension, will attract a penalty of 10% of the total marks available for the piece of assessment per calendar day or part thereof.

Simple extensions

If you encounter a problem submitting your work on time, you may be able to apply for an extension of five calendar days through a simple extension.  The application process will be different depending on the type of assessment and extensions cannot be granted for some assessment types like exams.

Special consideration

If exceptional circumstances mean you can’t complete an assessment, you need consideration for a longer period of time, or if you have essential commitments which impact your performance in an assessment, you may be eligible for special consideration or special arrangements.

Special consideration applications will not be affected by a simple extension application.

Word count penalty: A piece of assessment which exceeds the prescribed word limit will attract a penalty of 10% of the total marks available for the piece of assessment for every 100 words, or part thereof. The total word count for essay and other written assessments will exclude bibliography; footnote numbers; footnote citation; cover page and include body text; headings and sub-headings; quotations; anything other than numbers and citations in footnotes.

Referencing: The Sydney Law School expects you to use the Australian Guide to Legal Citation (4th edition, 2018) for your footnoting style, although you should confirm this with your lecturer, and a link to the library website where this is set out comprehensively is available at

Study commitment

Typically, there is a minimum expectation of 1.5-2 hours of student effort per week per credit point for units of study offered over a full semester. For a 6 credit point unit, this equates to roughly 120-150 hours of student effort in total.

Required readings

There is no single prescribed reading for the substantive seminars/sections – specific recommended readings are provided in the UoS outline.

For the negotiation exercise, there are prescribed readings. From 30 days before the seminars begin, students are supplied (through CANVAS) compulsory readings – including a Handbook on negotiation techniques; treaty texts, rules of procedure, and mock proposals, particular to the tailored negotiation exercise; and sets of individual instructions relevant to the specific state role-played in the exercise.

This section outlines changes made to this unit following staff and student reviews.

Over several years I have adapted this unit considerably in response to student feedback. The most important changes have been: > Separating the four consecutive seminar days into two blocks of two days each, with a week between them, to enable negotiation and reflection time between negotiating sessions. > Providing a new preparatory seminar on negotiation techniques before the exercise commences. > Providing a new debriefing and feedback session after the exercise concludes.

This unit provides a strong blend of theory and practice, to instil an understanding not just of law but also of the processes of law-making.

The teaching is informed by practical experience with real international law negotiations; and by substantial experience with the teaching of international environmental negotiation techniques.

As part of the learning experience, students are required to engage closely with the realities and viewpoints of states and cultures different to their own – including developing states, small island developing states, states with unique positions to protect, members of entrenched blocs, etc.
