LAWS6326: Interpretation of Statutes and Other Texts

Semester 2a, 2026 [Block mode] - Camperdown/Darlington, Sydney

Students will develop their understanding of the principles of statutory interpretation, and hone their ability to apply those principles in practice. The interpretation of contracts, constitutions and treaties will also be explored, observing where the core principles of statutory interpretation (text, context and purpose/intent) also apply to those texts, as well as learning rules particular to contracts, constitutions and treaties. Interpretation is a day-to-day task of the lawyer but many practising lawyers (and other professionals who work with the law) do not have a background in the discipline. This unit will teach the principles of interpretation, with a particular focus on practical application through the use of real-world examples, in-class exercises, and how to guides. It is assumed that students undertaking this unit have an understanding of Australian income taxation law commensurate with that, which would be obtained from completing undergraduate study in Australian taxation law or five years working with Australian taxation law in a law or accounting practice, in an industry role, or in the Australian Taxation Office. Students who do not have such knowledge or work experience should undertake LAWS6825 Fundamentals of Australian Taxation before enrolling in other units. For students who have not studied Australian law it is recommended that they undertake LAWS6252 Legal Reasoning and the Common Law System before enrolling in LAWS6825 and this unit.

Assessment summary

Early Feedback Task (0%): This unit includes an Early Feedback Task that is designed to provide students with timely insights into their understanding and engagement with the unit content. The Early Feedback Task in this unit is a multiple choice quiz of 8 questions. The task will be available on Canvas from 19 August 5pm to 20 August 9am, Sydney Australia time. It will be tailored to reflect key concepts from the first day of classes. Students will be provided with immediate automated feedback upon completion of the task.

In-semester test (40%): The test will have a number of questions, each requiring a short answer; all questions will be compulsory. You will have 1.5 hours plus 30 minutes reading time to prepare your response to the questions. The test will be held on Monday, 24 August at 10am.

Final exam (60%): The exam will be in the form of a number of problem style questions. You will have 2 hours plus 30 minutes reading time to prepare your responses to the questions. All materials and topics from the unit are examinable. The supervised final exam will be held on campus during the week beginning Monday 28 September 2026. The exam timetable will be released by the Exams Office in due course. For further information, please refer to Exam Timetables.  

 

Special consideration: Successful grants of Special Consideration may involve alternative tasks, as appropriate.

Assessment requirements to pass a unit of study:  A student must make a genuine attempt at all assessment tasks set out in this Unit of Study in order to obtain a Pass mark and grade (or above); otherwise an Absent Fail grade will be recorded as the student’s result for this Unit of Study. As the EFT is an early diagnostic tool, this task is not included in the final grade for the unit.

Late submission

In accordance with University policy, these penalties apply when written work is submitted after 11:59pm on the due date:

  • Deduction of 5% of the maximum mark for each calendar day after the due date.

Simple extensions

If exceptional circumstances mean you can’t complete an assessment, you need consideration for a longer period of time, or if you have essential commitments which impact your performance in an assessment, you may be eligible for special consideration or special arrangements.

Special consideration applications will not be affected by a simple extension application.

Attendance and class requirements

Attendance: All students are required to attend 70% of classes to satisfy the pass requirements for this unit. Failure to meet this requirement will result in an Absent Fail grade being recorded as the student’s result for this unit (see The University of Sydney Law School Resolutions: Coursework Awards cl 11).  

 

Study commitment

Typically, there is a minimum expectation of 1.5-2 hours of student effort per week per credit point for units of study offered over a full semester. For a 6 credit point unit, this equates to roughly 120-150 hours of student effort in total.

1. Textbook

Pearce, Statutory Interpretation in Australia (10th ed), LexisNexis, 2024

This textbook can be obtained from Booktopia or other online or physical bookstores.  The current (10th) edition is recommended.  Students who prefer to use an earlier edition are responsible for informing themselves as to the changes in the 10th edition.

2. Laws of Australia, Volume 25 “Interpretation and Use of Legal Sources”

Free online access to the Westlaw legal encyclopaedia Laws of Australia is available to students of Sydney Law School in the Legal Databases section of the Law School Library website.  In this unit of study we will refer from time to time to sections of Volume 25, Interpretation and Use of Legal Sources, which is found on the Legal Databases page under Westlaw Australia, Encyclopaedia, The Laws of Australia, Volume 25.

3. Case Law and Legislation

As shown in the Learning Guide which will be posted to Canvas, the unit of study will refer to case law and legislation on a regular basis.  Cases are available through the relevant legal databases through the links provided.  Students should obtain an up-to-date version of the legislation from the authorised government source (eg, for Commonwealth statutes this is www.legislation.gov.au, for New South Wales statutes it is www.legislation.nsw.gov.au, etc; the website www.legify.com.au is a useful tool for identifying these sources). 

4. Other readings

The Learning Guide which will be posted on Canvas refers to articles and other materials which are required and recommended reading (respectively) for the relevant class. Students can access these materials at the links provided, on the unit website or from the Law School Library.

5. Slides

Each week the lecture will be accompanied by slides which the lecturer will distribute in advance or at the start of the lecture. The slides will be posted to the unit website. The slides are required reading for the relevant lecture, and may contain some material which goes beyond the list of required reading for that lecture.
